What is Form 8938?

Why it matters on your return

Form 8938 goes with the tax return and covers foreign financial assets broadly: accounts, foreign stock held directly, foreign partnership interests, and some foreign pensions. Its thresholds are higher than the FBAR and depend on filing status and whether you live abroad. Filing one does not satisfy the other.

Example

A married couple living in the US holds $120,000 in foreign accounts at year end. They exceed the $100,000 joint threshold and file Form 8938 with their return, and separately file the FBAR.

What is the penalty for not filing Form 8938?

$10,000, plus up to $50,000 for continued failure after IRS notice, and the statute of limitations on the whole return stays open until it is filed.
