What is Net investment income tax?

A 3.8 percent tax on investment income, including capital gains and crypto gains, for taxpayers above $200,000 of income ($250,000 joint).

Why it matters on your return

It is easy to miss in planning. A large crypto gain that pushes you over the threshold is taxed at the capital gains rate plus 3.8 percent on the amount above the threshold.

Example

A single filer with $180,000 of wages sells crypto for a $100,000 gain. $80,000 of the gain sits above the $200,000 threshold and carries the extra 3.8 percent, about $3,000.

Does staking income count?

Yes. Staking, interest, and rental income are investment income for this tax; wages and active business income are not.
