Why it matters on your return

Timing is the whole question. A loss claimed in the year of the freeze may be premature if a distribution follows; a distribution received after a loss was claimed is income. What was reported in the freeze years dictates how the recovery is taxed.

Example

You held 2 BTC (basis $40,000) at an exchange that filed bankruptcy in 2022. In 2026 the estate pays you $30,000. If no loss was claimed earlier, you recognize a $10,000 capital loss now; if a full loss was claimed in 2022, the $30,000 is income in 2026.

When can I deduct crypto lost in an exchange bankruptcy?

When the claim is resolved: sold, paid out, or formally worthless. Claiming it the year the platform froze is usually too early and creates a mismatch when distributions arrive.
